29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Certified Roofing LLC at 125 Prentis Avenue, Vermillion, SD 57069: On or about and at times prior to March 13, 2024, the exposing employer did not ensure that frequent and regular inspections were conducted by a competent person. This condition exposed employees to various hazards such as fall hazards, lack of Personal Protective Equipment (PPE), ladder hazards, and a lack of training.

This condition exposed employees to fall hazards greater than six feet due to inadequate anchoring.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a)Certified Roofing LLC at 125 Prentis Avenue, Vermillion, SD 57069: On or about and at times prior to March 13, 2024, the exposing employer did not ensure that a Keller portable ladder being used to access the roof on a residential property was extended at least three feet above the edge located on the west side. This condition exposed employees to fall hazards.  (b)Certified Roofing LLC at 125 Prentis Avenue, Vermillion, SD 57069: On or about and at times prior to March 13, 2024, the exposing employer did not ensure that a Gorilla portable ladder being used to access the roof on a residential property was extended at least three feet above the edge located on the north side. This condition exposed employees to fall hazards.
