29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   a. 37 Ivy Street, Kearny, NJ - Roof  The employer did not ensure that employees were provided training on hazards associated with falls. Employees engaged in residential roofing activities worked at or near the edge, at heights greater than 6 feet, were hoisting materials, and removing and installing roofing materials where there were no means of fall protection.  Violation occurred on or about March 12, 2024.

29 CFR  1926.552(a)(1): The employer did not comply with manufacturer's specifications and limitations applicable to the operation of all hoists and elevators:  a. 37 Ivy Street, Kearny, NJ - Roof  The employer did not ensure the materials hoist used to lift roofing materials was compliant with the manufacturers specific requirement prior to using the equipment.  Employees used an RGC, model SH300, Hand Swing Hoist to place materials on the roof and did not secure the hoist base to prevent tipping of the hoist.  Violation occurred on or about March 12, 2024.

29 CFR  1926.552(b)(2): Entrance(s) of hoistway(s) were not protected by substantial gates or bars which guarded the full width of the landing entrance:   a. 37 Ivy Street, Kearny, NJ - Roof  The employer did not ensure the entrance of the hoistway was guarded. Employees used an RGC, model SH300, Hand Swing Hoist, which did not have the manufacturers guardrail installed and did not have a protected landing entrance by other means, causing employees to be exposed to fall hazards.    Violation occurred on or about March 12, 2024.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   a. 37 Ivy Street, Kearny, NJ - Roof  The employer did not ensure that employees were protected from falls.  Employees engaged in residential roofing activities worked at or near the edge at heights greater than 6 feet and were not protected from falls by use of a personal fall arrest system, guardrail system, safety net, or any other means of fall protection.  Violation occurred on or about March 12, 2024.  Four R Contracting LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1649620, citation number 1, item number 1, and was affirmed as a final order on March 30, 2023, with respect to a workplace located at 472 E 31st Street, Paterson, NJ 07504.
