29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his/her work environment to control or eliminate any hazard(s) or other exposure to illness or injury.  a) On or about March 20, 2024, inside the excavation, employees were exposed to struck-by hazards in that the employer did not conduct training on the hazards associated with pressure testing two 60" high pressure Kevlar and Rubber pipe bypass plugs in a 60-inch diameter x 260-foot-long underground storm water pipe.

29 CFR  1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  (Construction Reference 1926.103)  a) On or about March 20, 2024, inside the underground storm water pipe, employees voluntarily wearing HDX Particle N95 facepiece respirators while performing sanding and cleaning were not provided the basic advisory information contained in Appendix D.
