29 CFR 1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: On or about March 8, 2024, and at times prior to, the employer utilized a tubular weld scaffold without adequate fall protection while performing construction activities on the west side exterior of the building at a height approximately 28 feet to the ground.

29 CFR 1926.451(g)(4)(ii):The top edge height on all suspended scaffolds where both a guardrail and a personal fall arrest system were not between 36 inches (0.9 m) and 45 inches (1.2 m) above the platform surface: On or about March 8, 2024, and at times prior to, the employer utilized a tubular weld scaffold without adequate mid-rail while performing construction activities on the exterior of the building. This condition exposed employees to fall of approximately 28 feet to the ground below.

29 CFR 1926.451(g)(4)(iv): Midrails were not installed at a height approximately midway between the top edge of the guardrail system and the platform surface: On or about March 8, 2024, and at times prior to, on the west side of the jobsite; employees utilized a tubular welded scaffold without adequate top rail while performing construction activities on the exterior of the building. This condition exposed employee to fall greater than ten feet to the next lower level.
