Employees were required to wear negative pressure particulate respirator with a filter as an integral part of the facepiece, DuraMask 1895N Particulate Respirators, while operating a Hilti jackhammer were exposed to hazards associated with crystalline silica such as, but not limited to, cough, fatigue, shortness of breath and chest pain.

29 CFR 1926.1153(h)(1)(i):The employer did not make medical surveillance available at no cost to the employee, and at a reasonable time and place, for each employee who was required under this section to use a respirator for 30 or more days per year: Ohio State Home Services, Inc. doing business as Ohio State Waterproofing at the jobsite 39121 McIntosh Point Avon, Ohio: On or about March 14, 2024, the employer to did not make available to employees, who were required to wear a respirator for more than 30 days per year under 29 CFR 1926.1153, medical examinations consisting of: - A medical and work history, with emphasis on: past, present, and anticipated exposure to respirable crystalline silica, dust, and other agents affecting the respiratory system; any history of respiratory system dysfunction, including signs and symptoms of respiratory disease (e.g., shortness of breath, cough, wheezing); history of tuberculosis; and smoking status and history; - A physical examination with special emphasis on the respiratory system; - A chest X-ray; - A pulmonary function test; - Testing for latent tuberculosis infection; and - Any other tests deemed appropriate by the PLHCP. Employees required to wear negative pressure particulate respirator with a filter as an integral part of the facepiece, DuraMask 1895N Particulate Respirators, while operating a Hilti jackhammer were exposed to hazards associated with crystalline silica such as, but not limited to, cough, fatigue, shortness of breath and chest pain.

29 CFR 1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: Ohio State Home Services, Inc. doing business as Ohio State Waterproofing at the jobsite 39121 McIntosh Point Avon, Ohio: On or about March 14, 2024, the employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements outlining: (1) the selection of respirators for use, (2) medical evaluations of employees, (3) fit testing procedures, (4) cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators, (5) Training of employees in the respiratory hazards to which they are potentially exposed, (6) training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance, and (7) procedures for regularly evaluating the effectiveness of the program. Employees required to wear negative pressure particulate respirator with a filter as an integral part of the facepiece, DuraMask 1895N Particulate Respirators, while operating a Hilti jackhammer were exposed to hazards associated with crystalline silica such as, but not limited to, cough, fatigue, shortness of breath and chest pain.
