29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:  a) Lot 21, On or about April 2, 2024, the employer exposed employees to struck by hazards, in that protective eyewear was not provided to employees while operating pneumatic nail guns at 135 PSI while engaged in framing activities.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) Lot 21, On or about April 2, 2024, the employer exposed employees to fall hazards at heights of approximately 20-feet to the lower ground level on an 8/12 pitched roof, in that a fall protection system was not provided to employees engaged in framing activities.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) Lot 21, side wall: On or about April 4, 2024, the employer exposed employees to fall hazards, in that portable ladders were used for access to an upper level and the ladder side rails did not extend at least 3-feet over the landing surface.  b)  Lot 21, access to stop plate: On or about April 4, 2024, the employer exposed employees to fall hazards, in that portable ladders were used for access to an upper level and the ladder side rails did not extend at least 3-feet over the landing surface.
