29 CFR  1910.134(e)(1): General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  On or about February 27, 2024, employees were required to wear 3M 5201 half face respirator while adding the 2 part Resins to the resin reservoir , specifically the part 6 activator.  The employees were not medically evaluated to determine the employee's ability to use a respirator before the employee is fit tested or required to use the respirator in the workplace.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.1200(e)(1):The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in 29 CFR 1910.1200 (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met and which also includes the following:  1) Requirement for labeling and other forms of warning;  2)Employee information and training; 3) A list of hazardous chemicals known to be present in the workplace; 4)Methods to inform employees of the hazards on non-routine tasks;   On or about March 27, 2024, the employer exposed their employees to respiratory and health hazards such as 2 part resin, part 6 activator and  Krylon UV-Resistant Clear Acrylic Coating.  The employer, Sybridge Digital Solutions LLC did not develop, implement, and maintain at the workplace a written hazard communication which at least describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
