29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about April 9, 2024, located at 738 East Monroe Avenue, Hartford, WI 53027, the employer did not ensure employees used eye protection while using a pneumatic nail gun to install shingles on the two-story residential home, exposing employees to flying particles or impalement hazard from a deflected nail.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about April 9, 2024, located at 738 East Monroe Avenue, Hartford, WI 53027, the employer failed to ensure employees installing shingles on the second level of the residential condo were protected from falls by using a guardrail system, safety net system, or personal fall arrest system, exposing employees to a fall hazard of approximately 18 feet.  (b) On or about April 9, 2024, located at 738 East Monroe Avenue, Hartford, WI 53027, the employer failed to ensure employees installing underlayment and shingles on the first level of the residential condo were protected from falls by using a guardrail system, safety net system, or personal fall arrest system, exposing the employees to a fall hazard of approximately nine (9) feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  (a) On or about April 9, 2024, located at 738 East Monroe Avenue, Hartford, WI 53027, the employer failed to ensure that each employee installing underlayment and shingles on the two-story residential home and single story garage had been trained in the recognition of fall hazards and the implementation and use of fall protection, exposing employees to a fall hazard of up to 18 feet. 29 CFR  1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  (a) On or about April 9, 2024, located at 738 East Monroe Avenue, Hartford, WI 53027, the employer failed to ensure the extension ladder used to access the one-story garage extended at least three feet above the upper landing surface being accessed, exposing employees to a fall hazard of approximately nine (9) feet.
