29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a) On or about April 10, 2024, at the jobsite located at N67W21725 Bella Ct., Menomonee Falls, WI 53051 an employee was operating an all-terrain forklift (Caterpillar TL1055D), transporting trusses to framing employees to install, without receiving powered industrial vehicle (PIV) training.

29 CFR 1926.502(k)(6) The fall protection plan shall include a written discussion of other measures that will be taken to reduce or eliminate the fall hazard for workers who cannot be provided with protection from the conventional fall protection systems. For example, the employer shall discuss the extent to which scaffolds, ladders, or vehicle mounted work platforms can be used to provide a safer working surface and thereby reduce the hazard of falling.  (a) On or about April 10, 2024, at the jobsite located at N67W21725 Bella Ct., Menomonee Falls, WI 53051, employees were setting roof trusses on a residential home without any fall protection in place, exposing employees to a fall hazard of 14 feet to the ground below.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) On or about April 10, 2024, at the jobsite located at N67W21725 Bella Ct., Menomonee Falls, WI 53051, employees who were setting trusses on a residential house without fall protection in place did not have fall protection training, exposing employees to a fall hazard.
