29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a) Basement - On or about April 15, 2024, the employer failed to provide protection equipment against contact with overhead fire sprinkler pipe, sprinkler heads, and sewer piping that are 4.85 - 5.3 feet above the basement walkway, thereby exposing employees required to stock supplies, retrieve supplies, and perform housekeeping tasks to contact with hazards that may result in contusion and concussion. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (a) Facility wide - On or about March 16, 2024, the employer did not develop and implement a hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following: 1) Requirement for labeling of containers of hazardous chemicals; 2) Safety data sheet availability; 3) Training of employees; 4) A complete list of hazardous chemicals known to be present in the workplace; 5) Methods to inform employees of the hazards on non-routine tasks; and 6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system and any precautionary measures to protect employees. Employees were exposed to hazardous chemicals such as, but not limited to Ecolab Eco-San (contains sodium hypochlorite and sodium hydroxide), and chemicals in basement storage from when the establishment was an apothecary including liquid Ammonia, American Drug Industries, Inc. Sodium Silicate, United Drug Company Liniment Soap, Solution of Lime (contains calcium hydroxide), Larvex Moth Proofing Pesticide, Agoral Laxative, and Exo Products Company Carbon Tetrachloride. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv): (a) Facility wide - On or about March 16, 2024, the employer did not train employees in at least the following: 1) Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); 2) The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area; 3) The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; Employees were exposed to hazardous chemicals such as, but not limited to Ecolab Eco-San (contains sodium hypochlorite and sodium hydroxide), and chemicals in basement storage from when the establishment was an apothecary including liquid Ammonia, American Drug Industries, Inc.
