OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads:   b) Shank Bros Auto Transport LLC, 2305 Vestal Road, Vestal NY, 13850: On or about 4/19/2024, a mobile column Mohawk Resources Ltd., Lift Model Number MP-18-006, Serial Number B6N134, was operated without being inspected and certified since purchase of lift in December 2016.

29 CFR  1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tank cars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6:  a) Shank Bros Auto Transport LLC, 2305 Vestal Road, Vestal NY, 13850: On or about 4/19/24, two compressed oxygen gas cylinders (oxidizing gases) were stored next to portable propane tanks (flammable gases) and were not properly secured. Abatement certification is required.

29 CFR  1910.134(c)(2)(ii):The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a) Shank Bros Auto Transport LLC, 2305 Vestal Road, Vestal NY, 13850: On or about 4/19/24, the employer allowed voluntary use of 3M 07193 Dual Cartridge Disposable Respirators and did not ensure the employee was medically able to use that respirator.
