Instances of exposure include but are not limited to: i. On or about April 24, 2024, an employee with 10 years with the company operating both the JCB Telehandlers, and the CAT 2C6500 Forklift, without being trained on the hazards related to operating a forklift. ii. On or about April 24, 2024, an employee with 1 year with the company operating both the JCB Telehandlers, and the CAT 2C6500 Forklift, without being trained on the hazards related to operating a forklift. iii. On or about April 24, 2024, an employee with 9 years with the company operating the CAT 2C6500 Forklift without being trained on the hazards related to operating a forklift. iv. On or about April 24, 2024, an employee with 1 year with the company operating the CAT 2C6500 Forklift without being trained on the hazards related to operating a forklift. v. On or about April 24, 2024, an employee with 2 years with the company operating both the JCB Telehandlers, and the CAT 2C6500 Forklift without being trained on the hazards related to operating a forklift.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about April 24, 2024, employees who operate the Hyd-Mech S-23A Band Saw at the T&T Quality Buildings facility located at 89384 558th Ave, Fordyce, Nebraska were exposed to amputation hazards because the exposed cutting blade was not guarded to prevent contact. This was most evident on April 16, 2024, when the band saw operator reached in the area where the blade was operating because the arm that holds the blade was stuck on the clamp that holds the bundle. As she reached near the point of operation, her left hand was contacted by the running blade resulting in the amputation of her left hand.
