29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.  a) Worksite: 45 Oser Avenue, Hauppauge, NY, 11749 - Employees of Barret Roofs, Inc were on a roof 40-feet above the ground preparing the roof for installing roof curbs for the HVAC system. Employees from Jamco Air, LLC cut the decking material from inside the building exposing the employees from Barrett Roofs, Inc to fall hazards due to Barrett Roofs, Inc employees not having any form of fall protection in place; on or about April 26, 2024.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, not used where it was necessary by reason of hazards of processes:  a) Worksite, 45 Oser Avenue, Hauppauge, NY 11749 -  Employees on site were cutting roof decking overhead using a handheld grinding wheel and a Sawzall without the use of eye protection; on or about 4/26/2024.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
