29 CFR  1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8m) or more above the lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest systems.  Worksite:  80 Division Street, Patchogue, NY, 11772   On or about April 26th, 2024. Employees were framing the second-floor roof of a three story residential apartment building. Employees were not utilizing a means of fall protection and were exposed to falling approximately 20 ft to the ground below.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  Worksite:  80 Division Street, Patchogue, NY, 11772  On or about April 26th, 2024. Employees were using a Werner 24 ft extension ladder inside the house on the 2nd level to climb through an opening to gain access to the 3rd floor of a 3-story apartment building. The ladder did not extend 3 feet over the landing.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
