Work including removal of carpet and carpet foam stuck to asbestos-containing floor tiles occurred between February and March 2024, which potentially exposed employees to asbestos-containing material from broken floor tiles. Fit testing for employees doing asbestos work was not maintained.

The employer did not provide and require the use of protective clothing, such as coveralls or similar whole-body clothing, head coverings, gloves, and foot coverings for any employee conducting work for which a required negative exposure assessment is not produced.  Lighthouse Apartments: On or about February 2024, employees applied an encapsulating primer to the asbestos-containing floor tile/mastic of one of the units. Employees also removed carpet and carpet foam from on top of asbestos-containing floor tiles. No negative exposure assessment was provided prior to this work being conducted.   The employer did not provide and require the use of protective clothing as required for this task when there is no negative exposure assessment. This condition potentially exposed employees to contact with asbestos fibers which can cause respiratory illness.

29 CFR  1926.1101(k)(9)(i): The employer did not train each employee who is likely to be exposed in excess of a PEL, and each employee who performs Class I through IV asbestos operations, in accordance with the requirements of this section.  Lighthouse Apartments:  On or about February 2024, the employer did not ensure each employee who performed class III and class IV asbestos operations was trained in accordance with the requirements of this section.  Employees did class III asbestos work including application of "Perfect Primer Encapsulant" on the floor of unit C. Class IV work was also done. Some floor tiles were broken in the units. The cleanup of these floor tiles was class IV asbestos work because the floor tiles had asbestos and asbestos mastic. This work potentially exposed employees to contact with asbestos fibers which can cause respiratory illness.
