On or about April 26, 2024, at the work location at 8913 State St, Kinsman Ohio 44428, the employer did not ensure that powered industrial vehicles (PIVs) were taken out of service until restored to safe operating conditions. The braking system of 1968 Caterpillar b20 forklift loader was out of compliance with the manufacturer's recommended specifications preventing it from effectively stopping/slowing the rate of travel to prevent accident and/or injury.

The exposed employees utilized the alloy steel chain continuously to load and unload multiple shipments of concrete products in the north truck yard of the facility.
