29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. Blast Booth: A sand blaster was exposed to a noise dose of 696%, or an equivalent dBA of 104dBA, which was capable of causing permanent hearing loss. The sampling was performed for 240 minutes during one shift on May 8, 2024. The employer did not have a continuing, effective hearing conservation program.

29 CFR 1910.1000(a)(2): An employee was exposed to an airborne concentration of Particulates Not Otherwise Regulated (PNOR) listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentration of 5 mg/m� (Respirable Fraction): a. Blast Booth: On or about May 31, 2024, the employer exposed a sand blaster to an 8-hour calculated Time Weighted Average (TWA) of 6.2 mg/m�, which is 1.2 times the 8-hour TWA Permissible Exposure Level (PEL) of 5 mg/m� while conducting sand blasting operations. Results were calculated based on the 100 minute sampling period.
