On or around May 7, 2024, at a worksite situated at N4275 County Road A, Black Creek, Wisconsin: employees were exposed to fall hazards when an operator of a SKYTRAK Telehandler rough terrain forklift (Model No.: 8042, Serial No.: 0160112617) lifted the employees on a platform (pallet) without having the necessary training and certification for its safe use.

29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.  On or about May 7, 2024, at a worksite located at N4275 County Road A, Black Creek, Wisconsin: the employer did not ensure that a platform(pallet) being utilized to lift personnel using a SKYTRAK Telehandler rough terrain forklift (Model No.: 8042, Serial No.: 0160112617) was designed by a qualified person. Employees were exposed to a fall of over 10 feet when using a work platform (pallet) without guardrails or any other form of fall protection.

On or about May 7, 2024, at a worksite located at N4275 County Road A, Black Creek, Wisconsin: the employer failed to protect employees from fall hazards of over 10 feet while they were working off a platform (pallet) elevated on the forks by a SKYTRAK Telehandler rough terrain forklift (Model No.: 8042, Serial No.: 0160112617), which was not approved by the manufacturer to lift personnel.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  On or about May 7, 2024, at a worksite located at N4275 County Road A, Black Creek, Wisconsin: the employer failed to protect employees from fall hazards of over 10 feet while they were working off a platform (pallet) elevated on the forks by a SKYTRAK Telehandler rough terrain forklift (Model No.: 8042, Serial No.: 0160112617).  Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.
