29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s) a) On or about May 05, 2024, at the worksite: employees were exposed to struck-by hazards while operating the Mitsubishi forklift Model; FGN25, Serial Number AF17E02492 with excessively worn tires that could affect its balance, in that, the forklift was not taken out of service. b) On or about May 05, 2024, at the worksite: employees were exposed to struck-by hazards while operating the green Mitsubishi forklift model; FGN25, with an unsecured propane tank as the tank mounting bracket was missing.
