Corrected during the inspection, no abatement certification or documentation required.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary.  a) Mountain View Terrace Mobile Home Park, Hollow Creek Road, Dover, PA - On or about May 9, 2024, employees worked in a straight cut trench at a depth of approximately 7 feet�where the spoil pile was less than 2 feet from the edge, exposing employees to caught-in and struck-by hazards.  Corrected during the inspection, no abatement certification or documentation required.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  a) Mountain View Terrace Mobile Home Park, Hollow Creek Road, Dover, PA - On or about May 9, 2024, employees worked in a straight cut trench that had not been evaluated by a competent person prior to entry, exposing the employees to a caught in/struck by hazard.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
