29 CFR 1910.178(l)(2)(ii) is applicable to construction employment as referenced by 1926.602(d): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  The employer failed to protect employee(s) from struck by hazards. This was most recently documented on or about May 15, 2024 at or about 2930 Northstar Crossing Drive, Lincoln, Nebraska. Operator of the powered industrial truck JLG 660SJ All-Terrain Forklift, SN: 0300173999 did not successfully complete the training requirements in accordance with this sub part.

This was most recently documented on or about May 15, 2024 at a construction jobsite located at or about 2930 Northstar Crossing Drive, Lincoln, Nebraska. Employee(s) were framing a residential roof while working at a height of approximately 27 feet measured from the ground to eave without fall protection.
