Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On or about May 16, 2024, Weidenbein Enterprises, Inc., did not ensure that their accident prevention program included providing for adequate frequent and regular inspections to be conducted by a competent person designated by Weidenbein Enterprises for the large area scaffold located at the job site located at 600 Buckskin Trail Xenia, OH 45385, in that Weidenbein Enterprises employee(s) were exposed to fall hazards due to improperly installed guardrails on the 6 buck scaffold, in that portions of the scaffold was not fully planked, there was a damaged fixed ladder that was bent used to access and exit the scaffold, and the scaffold erected over 24' and was not tied into the building.

Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity. a) On or about May 16, 2024, Weidenbein Enterprises, Inc. did not ensure the tubular welded scaffolding system scaffolding components were inspected for visible defects by a designated competent person before each work shift in that the tubular welded scaffold located on the East Wall of 600 Buckskin Trail Xenia, OH 45385 was not fully planked, had a damaged ladder where the side rails were bent, the scaffold was not tied into the structure over 20' from ground, and had guardrails missing where employees were laying brick at approximately 18 feet from the ground.

29 CFR 1926.451(b)(1):Scaffold platform construction. Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows: (b)(1)(i) Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) shall be installed so that the space between adjacent units and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary (for example, to fit around uprights when side brackets are used to extend the width of the platform). a) On or about May 16, 2024, Weidenbein Enterprises, Inc. did not ensure the 3rd level or buck of the East Wall tubular welded scaffold located at 600 Buckskin Trail Xenia OH 45385 was fully planked near the vertical upright in that employees were working on the third buck of the scaffold around a hole more than 1 inch wide due to not being fully planked, exposing them to trip hazards and a fall hazard of approximately 18 feet.

29 CFR 1926.451(c)(1)(ii):Criteria for supported scaffolds. Guys, ties, and braces shall be installed according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and be repeated vertically at locations of horizontal members every 20 feet (6.1 m) or less thereafter for scaffolds 3 feet (0.91 m) wide or less, and every 26 feet (7.9 m) or less thereafter for scaffolds greater than 3 feet (0.91 m) wide. The top guy, tie or brace of completed scaffolds shall be placed no further than the 4:1 height from the top. Such guys, ties and braces shall be installed at each end of the scaffold and at horizontal intervals not to exceed 30 feet (9.1 m) (measured from one end [not both] towards the other). a) On or about May 16, 2024, Weidenbein Enterprises, Inc. did not ensure guys, ties, and braces were installed on the tube scaffold that was erected approximately 36 feet or 6 bucks high located at 600 Buckskin Trail Xenia, OH 45385 while employees were laying brick, exposing them to a fall hazard of approximately 18 feet caused by the potential for the scaffold to collapse or tip over.

29 CFR 1926.451(g)(1):Fall protection. Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. a) On or about May 16, 2024, Weidenbein Enterprises, Inc. did not adequately protect each employee with fall protection while laying brick on the East Wall scaffold located at 600 Buckskin Trail Xenia OH 45385 from fall hazards of approximately 18 feet while retrieving materials through a gap approximately 18 inches wide.
