29 CFR 1910.1200(e)(1)(i): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: a list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas).    In the service and detailing department at 865 Quaker Hwy. Uxbridge MA 01569: On or about May 17, 2024, at times prior, and at times after, hazard communication program safety data sheet binder did not include a current list of hazardous chemicals as required. A list of hazardous chemicals known to be present was not available at the time of the inspection.  Hazardous chemicals present in the work area and used by detailing and service technicians include:     1. Acrysol, (multiple 1 qt containers found in storage and in use) which contains a mix of Xylene (CAS-No: 1330-20-7), Ethyl benzene (CAS-No:100-41-4), Toluene (CAS-No: 108-88-3) and Solvent naphtha(petroleum), light aliphatic, (CAS-No: 64742-89-8).   2. Meguiar's (D101) all-purpose cleaner: (full dispensing system in place, multiple size containers and refillable bottles) Contains Alkoxy Alcohol (CAS-No.111-76-2)   3. Meguiar's (D120) glass cleaner: (full dispensing system in place, multiple size containers and refillable bottles) Contains 2-Butoxyethanol (CAS-No. 111-76-2 ) and Isopropyl Alcohol (CAS-No. 67-63-0)  Although the Area Office held a conference with the employer prior to issuing this citation and the others now being issued in this inspection, the issuance of these citations does not represent the end of the inspection. The inspection is still open, due to the employer's failure to comply with the subpoenas that OSHA issued and served during the inspection. The Acting Secretary of Labor has filed a petition for subpoena enforcement in the U.S. District Court of Massachusetts, as part of which the Asking Secretary has asked that the statute of limitations for OSHA to issue citations be tolled.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identified the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and which identifies the document as a certification of hazard assessment:  In the service and detail department at 865 Quaker Hwy. Uxbridge MA 01569:  On or about May 17, 2024, at times prior, and at times after, employees working in the detailing and service departments wore personal protective equipment to include N-95 filtering facepiece device respirators, gloves, safety shoes and safety glasses for detailing and maintenance of recreational vehicles and no written certification of a hazard assessment had been completed.  Although the Area Office held a conference with the employer prior to issuing this citation and the others now being issued in this inspection, the issuance of these citations does not represent the end of the inspection. The inspection is still open, due to the employer's failure to comply with the subpoenas that OSHA issued and served during the inspection. 29 CFR 1910.134(c)(2)(i): 29 CFR 1910.134(c)(2)(i): When the employer determined that any voluntary respirator use was permissible, the employer did not provide the respirator users with the information in Appendix D of this section ("Information for Employees Using Respirator When Not Required Under the Standard"):   In the service department at 865 Quaker Hwy. Uxbridge MA 01569:  On or about May 17, 2024, at times prior, and at times after, the information in 29 CFR 1910.134 Appendix D was not provided to employees who use 3M tight-fitting elastomeric respirators with cartridges and N95 filter face piece disposable respirators on a voluntarily basis.  Although the Area Office held a conference with the employer prior to issuing this citation and the others now being issued in this inspection, the issuance of these citations does not represent the end of the inspection. The inspection is still open, due to the employer's failure to comply with the subpoenas that OSHA issued and served during the inspection.
