29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b)  On or about May 21, 2024, at the above addressed jobsite, employee(s) performing residential roofing operations, eight (8) feet nine (9) inches above ground level, were not protected from falls, thereby exposing the employee(s) to fall hazards.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On or about May 21, 2024, the portable ladder used to access the upper framing roof platform did not extend at least three (3') feet above the upper landing surface nor was it secured at the top, thereby exposing employees to the hazards associated with falls.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification records including the name or other identify of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or signature of the employer.   a. On or about May 21, 2024, at the above addressed jobsite, employees performing residential roofing operations had been provided fall protection training; however, the employer failed to keep a written certification record of the training.
