Pflumm Rd. Olathe, Kansas, employees performing concrete dowel drilling activities were exposed to health hazards in that the employer had not determined, through a medical evaluation, the employees' ability to use a respirator before the employee(s) are fit tested or required to use a respirator. Employees were required to use 3M N95 respirators.

29 CFR 1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1. At the jobsite located at 15325 S. Pflumm Rd. Olathe, Kansas, employees performing dowel Drilling activities were exposed to silica hazards. The employer failed to implement engineering and work practice controls as outlined in Table 1 to reduce employee exposure to silica dust. Gunter Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1153(c)(1), which was contained in OSHA inspection number 1589344 , citation number 1, item number 1 and was affirmed as a final order on July 19, 2022, with respect to a workplace located at 6300 MO Hwy 9, Parkville, MO. 64152.
