29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  At the workplace located at 4026 SW Topeka Blvd. Topeka, Kansas 66609, employee(s) engaged in cutting, grinding and painting activities in the fabrication area of the facility are exposed to pulmonary hazards and/or cardiac stress hazards when using employer required respirators. The employer requires employee(s) to wear 3M 6000 half-face respirators with organic vapor (OV) and P100 performance cartridges when conducting cutting, grinding and painting activities without having been provided medical evaluations prior to respirator use.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or were not packed or stored to prevent deformation of the facepiece and exhalation valve:  At the workplace located at 4026 SW Topeka Blvd. Topeka, Kansas 66609, employee(s) engaged in cutting, grinding and painting activities in the fabrication area of the facility are exposed to respiratory irritation and chemical hazards. The employer failed to ensure all fabrication employees, required to wear a 3M 6000 half-face respirator, properly store their respirator. Respirators were openly stored on a red toolbox in the fabrication area and were not protected from chemical residue or dust.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:  At the workplace located at 4026 SW Topeka Blvd. Topeka, Kansas 66609, employee(s) engaged in chemical handling activities in the fabrication area of the facility are exposed to chemical hazards when handling unlabeled chemical containers. Unlabeled secondary chemical spray bottles filled with 91% isopropyl alcohol, Rapid Remover adhesive remover and SuperClean degreaser were found unlabeled at the fabrication area of the facility. Exposure to these chemicals could result in: skin irritation, allergic skin reaction, serious eye irritation, respiratory irritation, nausea and/or vomiting, headaches and/or dizziness, pulmonary edema, and may be fatal if swallowed and enters airways. Additionally, 91% isopropyl alcohol and Rapid Remover adhesive remover, can both act as fueling agents due to their extreme flammability as a liquid and vapor.
