29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not used when it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: a) 159 Alexander Street, Yonkers, NY - Building C - 1st Floor - On or about 5/28/24, employees mixing and handling Laticrete 252 Silver Adhesive Mortar (portland cement - corrosive) did not use gloves to prevent skin contact with this chemical. The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19, failure to comply will result in additional penalty of $ 1,000.00.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: a) 159 Alexander Street, Yonkers, NY - Building C - 1st Floor - On or about 5/28/24, employees were performing tile work were using hazardous chemicals including but not limited but not limited to Laticrete 252 Silver Adhesive Mortar (portland cement - corrosive), Perma Color Grout (calcium alumina cement, portland cement) etc. and the employer did not development and implement a written hazard communication program. The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19, failure to comply will result in additional penalty of $ 1,000.00.

In addition to abatement certification, the employer is required to submit abatement documentation for this item. Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19.
