29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met, and had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   a.) 1420 Arcadia Rd, Lancaster, PA  - Company Wide - Employees were using chemicals including, but not limited to, petroleum-based products (lubricants/solvents). The employer did not have written hazard communication program, on or about June 7, 2024.  b.) 1420 Arcadia Rd, Lancaster, PA   - Company Wide - Employees were using chemicals including, but not limited to, petroleum-based products (lubricants/solvents). The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet(s), on or about June 7, 2024.

29 CFR 1910.1200(h)(1):  Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a.) 1420 Arcadia Road, Lancaster, PA - Company Wide - Employees were using chemicals including, but not limited to, petroleum-based products (lubricants and solvents), and did not have have hazard communication training, or about June 7, 2024.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a.) 1420 Arcadia Rd, Lancaster, PA - Maintenance/Storage Area - On or about June 7, 2024, employees were not trained/certified to operate the employer's powered industrial trucks.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
