29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at the job site at 9531 Mitchell-Dewitt Road, Plain City, Ohio: On or about April 27, 2024, and at times prior, the employer did not ensure that an accident prevention plan was initiated and maintained to ensure that employees performing roofing work were protected including programs such as but not limited to; fall protection/prevention, ladder safety, and personal protective equipment. As a result, employees were exposed to fall and struck-by hazards.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a. Located at the job site at 9531 Mitchell-Dewitt Road, Plain City, Ohio: On or about April 27, 2024, the employer did not ensure that employees performing roofing replacement work on an existing home utilized fall protection/prevention measures. As a result, employees were exposed to falls of approximately 10 feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. Located at the job site at 9531 Mitchell-Dewitt Road, Plain City, Ohio: On or about April 27, 2024, and at times prior, the employer did not initiate and maintain a fall prevention/protection training program to ensure employees performing roofing work were adequately trained on fall hazards and procedures to minimize falls. As a result, employees were exposed to fall hazards of approximately 10 feet while performing roofing work.

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  a. On or about April 27, 2024, JLL Roofing LLC did not report an employee hospitalization within 24 hours that occurred as a result of a fall from a roof that resulted in a seven-day hospitalization and spinal fractures to an employee.
