29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity: a) On or about May 31, 2024, the exposing employer, Jalico Construction, LLC, did not ensure the Bil-Jax mobile scaffolding equipment used by employees was inspected for defects by a competent person before the work shift. Employees were required to use the Bil-Jax mobile scaffolding to reach popcorn ceiling material to be scraped in the salon area and were injured during this mobile work operation due to mobile scaffold tipping, collapse, and separation upon ground impact. This condition exposed employees to scaffolding collapse and associated fall and struck-by injuries.

29 CFR 1926.452(w)(6)(i): The employer did not ensure that employees were not allowed to ride on scaffolds unless the ft the surface on which the scaffold is being moved is within 3 degrees of level, and free of pits, holes, and obstructions: a) On or about May 31, 2024, the exposing employer, Jalico Construction, LLC, did not ensure the surface on which the Bil-Jax mobile scaffolding set used by employees was free of pits, holes, and obstructions that could result in tipping and collapse during required scaffold movement. Employees were required to use the Bil-Jax mobile scaffolding to reach popcorn ceiling material to be scraped in the Salon Area and were injured during this mobile work operation due to mobile scaffold tipping, collapse and separation upon ground impact. This condition exposed employees to scaffolding collapse and associated fall and struck-by injuries.

29 CFR 1926.1101(k)(3)(i): Before work in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM) was begun; the employer did not identify the presence, location, and quantity of ACM, and/or PACM therein pursuant to paragraph (k)(1) of this section: a) On or about May 31, 2024, and at times prior, the exposing employer, Jalico Construction, LLC, did not identify the presence, location, and quantity of ACM and/or PACM when employees were required to scrape and remove popcorn ceiling texturing in the salon area of the building that was constructed in 1969. This condition potentially exposed employees to potential respiratory injury from asbestos fibers.
