IN THE ALTERNATIVE:   OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in and struck-by hazards by an energized conveyor system while working inside the guard/fence.   a) Automated Facility in the Consolidation Center - On May 31, 2024, and times prior to, the employer exposed employees to caught-in and struck-by hazards, in that adequate protections were not established and utilized by employees that performed work on an energized conveyor system.
