29 CFR  1910.1053(d)(1):  The employer shall assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section:  On or about June 18, 2024, at a worksite located at 315 W Washington St Garage (Green Ramp) in Appleton, WI; the employer did not assess the exposure of each employee who may be exposed to respirable crystalline silica at or above the action level when employees utilized a metal wire wheel brush to clean and detail concrete expansion joints prior to placing backer rod and caulk in the joints. The employer did not conduct personal exposure monitoring to determine if employees were exposed to respirable crystalline silica generated by the dry brushing process.
