OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while riding on a pallet on the forks of a forklift.  On or about June 11, 2024, an employee was elevated on a pallet on the forks of a Crown forklift in order to access wiring and install a camera base inside the building near the storage area. The unapproved work platform exposed the employee to potential fall hazards.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  On or about June 17, 2024, employees in the packaging area of the facility were exposed to struck by hazards by inadvertent contact to the rotating parts associated with the pallet wrapping machine and caught in hazards due to the lack of machine guarding.

29 CFR  1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.   a. On or about June 3, 2024, the employer did not ensure that each operator of walk-behind powered industrial vehicles had received formal instruction and evaluation of the operator's performance in the workplace.   b. On or about July 10, 2024, the employer did not ensure that each forklift operator in the packaging area was provided with formal instruction, practical training, and evaluation as part of the forklift training program.
