OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to rollover and struck-by hazards when operating a 2007 Sterling Model L9500 semi-truck with a Grapple boom, Rotobec 80 Elite  Loader:   (a) On or about June 18, 2024, at the landfill, the employer failed to ensure drivers/operators set the brakes and used the outriggers prior to operating grapple boom trucks in accordance with the manufacturer instructions.

29 CFR 1910.151(b): There was neither an infirmary, clinic, or hospital used for the treatment of all injured employees in near proximity to the workplace nor a person or persons adequately trained to render first aid:  On or about June 18, 2024, employees were engaged in tree removal activities in locations not within a reasonable proximity to medical facilities and there was a lack of trained persons to render first aid.
