OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to crushing hazards while operating a forklift that overturned on its side without wearing a seat belt.  Location: 130 North Plains Industrial Road, Wallingford, CT 06492  The employer did not ensure that all employees were required to wear a seat belt when operating powered industrial trucks.  On/or about June 21, 2024, an employee was exposed to struck-by/crushing hazards and was fatality injured while operating the Unicarrier P5147 powered industrial truck without wearing a seatbelt.

29 CFR  1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):  WORKSHOP/WAREHOUSE:  : On/or about June 21, 2024 and prior to, the employer did not service the Unicarrier P1547, model MCP1F2A20LV, S/N CP1F2-9W26491,  powered industrial truck (PIT) which had the following defects and was not removed from service:  1.	Right front tip of the fork was broken/missing. 2.	Shrink wrap/banning wrapped around front right passenger tire. 3.	All wheels had missing pieces of tires.
