29 CFR 1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section:  Office/Dispatch Area: On or about June 27, 2024, the employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level when plant maintenance activities directly outside the dispatch office area resulted in the migration of concrete dust onto workplace surfaces of the office. Employees were exposed when concrete dust migrated through a breach in an office ceiling and through the adjacent windows and vents.  Office personnel affected by inhalation exposures were not assessed in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section when dusty operations including heavy equipment that loaded and weighed aggregate cement stone directly outside the office window was performed near their work area.
