29 CFR  1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.  a. On or about July 1, 2024, the access to the emergency exit door, located between the overhead doors in the dock area, was obstructed by pallets with ATV seats, wooden crates filled with empty cardboard boxes, and other miscellaneous debris.

Self-luminous or electroluminescent signs that have a minimum luminance surface value of at least .06 footlamberts (0.21 cd/m2) are permitted.  a. On or about July 1, 2024, the employer did not ensure that an exit sign above an emergency exit door, located between the overhead doors in the dock area, was illuminated for visibility during an emergency.  b. On or about July 1, 2024, the employer did not ensure that an exit sign above an emergency exit door, located to the left of the overhead doors in the dock area, was illuminated for visibility during an emergency.

29 CFR  1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  a. On or about July 1, 2024, the employer did not conduct a performance evaluation of an employee who operated the Crown sit-down forklift, item number 139886/7, and the Toyota electric forklift, model 8FBCU20, serial number 71697, to perform warehouse activities, such as storing full pallets onto racking, and retrieving products from storage racking.

29 CFR  1910.305(a)(2)(x): Flexible cords and cables shall be protected from accidental damage, as might be caused, for example, by sharp corners, projections, and doorways or other pinch points.  a. On or about July 1, 2024, a flexible cord that run across the warehouse floor, and was used to provide power to printers, was not protected from accidental damage caused by the forklift traffic over the flexible cord.

29 CFR  1910.305(g)(1)(iv): Unless specifically permitted otherwise in paragraph (g)(1)(ii) of this section, flexible cords and cables may not be used:  29 CFR  1910.305(g)(1)(iv)(A): As a substitute for the fixed wiring of a structure;  a. On or about July 1, 2024, an extension cord was being used as fixed wiring to power a Better Pack 555eS tape machine which had a voltage of 115V and was located at the end cap of the storage racking in the dock area in the warehouse.  b. On or about July 1, 2024, and extension cord was being used as fixed wiring to power a package label printer located outside the office door in the warehouse.
