29 CFR  1926.102(a)(1):The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) New residential construction: On 7/8/2024, the employer exposed employees to struck-by hazards while using Coosa Portland Cement in that no eye protection was not provided to employees.  b) New residential construction: On 7/8/2024, the employer exposed employees to struck-by hazards while operating DeWalt Chop Saw and Ryobi Circular Saw in that no eye protection was not provided to employees operating these tools.

29 CFR  1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:  a) At the new residential construction: On 7/8/2024, the employer exposed employees to severe lacerations and/or amputation hazards, in that DeWalt Chop Saw's spark guard was not operational during use as a piece of cloth was used to keep the spark guard back exposing the blade.

29 CFR 1926.1153(c)(1): Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) New residential construction: On 7/8/2024, the employer exposed employees to respiratory hazards due to silica exposure from dry cutting stone pavers without any engineering controls, work practices, or respiratory protection as described in Table-1. The employer failed to enforce the use of a saw that is accompanied for wet cutting.
