29 CFR 1910.36(d)(1):Employee(s) were not able to open an exit route door from the inside at all times without keys, tools, or special knowledge: On or about 07/09/2024 at 1980 Amsterdam Avenue New York, NY 10032, employees working in the basement doing tasks such as, but not limited to, retrieving bottles of soda, cleaning supplies, and frozen food from the basement were exposed to an exit route door which could not be opened without keys. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

The employer failed to keep the basement exit door free and unobstructed. NOTE: THE EMPLOYER IS NOT REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM PER 29 CFR 1903.19 BECAUSE THE ITEM WAS CORRECTED DURING THE INSPECTION.
