29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On or before July 9, 2024, and at times prior, the employer did not effectively nor adequately maintain a written hazard communication program in that the employer failed to provide Safety Data Sheets (SDSs) and require proper chemical labeling on containers. This condition exposed employees to chemical hazards.

29 CFR 1910.1200(f)(6)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals:  a) On or before July 9, 2024, and at times prior, the employer did not ensure secondary containers of chemicals were labeled correctly with the chemical content of the container and the hazard warnings of the chemical contained therein. There were unlabeled containers including spray bottles, buckets and plastic containers in the service shop. This condition exposed employees to skin, eye and respiratory hazards.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical:   a) On or before July 9, 2024, and at times prior, the employer did not ensure that safety data sheets (SDS) with information on hazardous chemicals in their work area were readily available on site. Employees were exposed to chemical hazards including but not limited to corrosive cleaning agents. This condition exposed employees to skin, eye and respiratory hazards.
