29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:   a) Lot Lot 76, top plate: On or about July 15, 2024,  the employer exposed employees to struck-by hazards, in that protective eyewear was not provided to employees while operating Bostitch and Pneutools framing nail guns at 125 PSI while engaged in framing and sheathing activities.  b) Lot Lot 76, second level: On or about July 15, 2024, the employer exposed employees to struck-by hazards, in that protective eyewear was not provided to employees operating Makita circular saws engaged in framing activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) At Lot 76, Top plate: On or about July 15, 2024, the employer exposed employees to fall hazards of approximately 28-feet to the lower level, in that a fall protection system was not provided to employees engaged in framing activities using the top plate as a walking/working surface.   b) At Lot 76, Second level: On or about July 10, 2024, the employer exposed employees to fall hazards of approximately 12-feet to the lower level, in that a fall protection system was not provided to employees engaged in framing activities.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) Lot 76, Second level to top plate: On or about July 15, 2024, the employer exposed employees to fall hazards up to 8-feet to the lower 2nd floor level, in that a ladder  that can extend at least 3-feet past the point of access was not provided. Employees were using a 4-foot A-frame ladder to access a height greater than 8-feet to the second level top plate to gain access to the roof.
