29 CFR 1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a) New residential building located at Lot 33, White Tail Road, Stockbridge, GA 30281, on second floor landing: On or about 7/01/2024, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic nail guns, in that protective eyewear was not provided to employees engaged in framing activities.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) New residential building located at Lot #33, White Tail Road, Stockbridge, GA 30281, on second floor landing, the employer exposed employees to fall hazards of heights approximately 10-feet, 8-inches to the lower level, in that a fall protection system was not provided as employees were engaged in framing activities.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) New residential construction located on Lot #33 at White Tail Road, Stockbridge, GA 30281, Left side of structure: On or about 07/01/2024, the employer exposed employees to fall hazards of approximately 13-feet to the lower ground level, in that a ladder with extended side rails at least 3-feet was not provided to employees accessing the second floor landing.
