29 CFR  1910.178(l)(1)(i):  This provision is applicable to construction employment by 29 CFR 1926.602(d):   The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   On or about June 20, 2024, employees engaged in construction activities on the jobsite located at 1670 Hwy 26, Oshkosh, Nebraska were exposed to struck by hazards in that they had not been trained to operate the Lull 944E-42 Rough Terrain Forklift they were using to load steel beams onto a flatbed trailer.

29 CFR  1904.39(a)(2):  The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization:   On or about June 20, 2024, employees engaged in construction activities at the job site located at 1670 Hwy 26, Oshkosh, Nebraska, were exposed to work place hazards in that JRS Welding and Construction, LLC, failed to report an employee's in patient hospitalization as a result of a work place incident within 24 hours to OSHA.
