29 CFR  1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  (a) TradeMark Contractors, 110 Gino Dr., Bristol, CT 06010: On or before July 25, 2024, and at times prior,  an employee entered a trench 6 feet deep without means of safe egress. Employees exited the protective system which located at the north end of the trench and exited via the non-structural ramp located at the south end of the trench. This exposed employees to cave-in hazards.

29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.   (a)TradeMark Contractors, 110 Gino Dr., Bristol, CT 06010: On or before July 25, 2024, and at times prior, the competent person on-site did not conduct an inspection to recognize unsafe conditions in a trench and allowed workers to enter and work in an excavation that was not free of hazards such as lack of egress and unsafe protective systems.

29 CFR  1926.652(g)(1)(ii):Shields were not installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads:  (a)TradeMark Contractors, 110 Gino Dr., Bristol, CT 06010: On or before July 25, 2024, and at times prior, employees were working inside a trench box that was not situated flush against the side of the excavation, exposing employees to hazardous movement of the protective system in the event of sudden lateral loads.
