29 CFR 1910.1030(c)(1)(i): Each employer having an employee(s) with occupational exposure as defined by paragraph (b) of this section shall establish a written Exposure Control Plan designed to eliminate or minimize employee exposure. On or about July 29, 2024, the employer did not develop a written exposure control plan for employees with occupational exposure to blood and other potentially infectious materials (OPIM).

29 CFR 1910.1030(f)(2)(i): Hepatitis B vaccination shall be made available after the employee has received the training required in paragraph (g)(2)(vii)(I) and within 10 working days of initial assignment to all employees who have occupational exposure unless the employee has previously received the complete hepatitis B vaccination series, antibody testing has revealed that the employee is immune, or the vaccine is contraindicated for medical reasons. On or about July 29, 2024, the employer did not ensure that the Hepatitis B vaccination was provided to employees with an occupational exposure.

Such training must be provided at no cost to the employee and during working hours. The employer shall institute a training program and ensure employee participation in the program. On or about July 29, 2024, the employer did not ensure that bloodborne pathogens training was provided to employees with an occupational exposure at the time of initial assignment.
