29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) HSA Construction, LLC failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:   Citation 1, Item 1 a serious violation of 29 CFR 1926.20(b)(2) with an abatement date of October 22, 2024.  Citation 1, Item 2 a serious violation of 29 CFR 1926.102(a)(1) with an abatement date of October 22, 2024.  Citation 1, Item 3 a serious violation of 29 CFR 1925.501(b)(13) with an abatement date of October 22, 2024.  Citation 1, Item 4 a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of October 22, 2024.  Citation 1, Item 5 a serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of October 22, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

(a) On or about July 31, 2024, at W257S5357 Wood Lilly Ln, Waukesha, WI 53189, the employer did not ensure employees conducting installation of a new residential roof, using hand tools and nail guns were wearing eye protection. This exposed the employees to struck by hazards and eye injuries.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about July 31, 2024, at W257S5357 Wood Lilly Ln, Waukesha, WI 53189, employees installing a roof on a residential home roof with a 6:12 pitch were not using fall protection. This exposed employees to a fall hazard of approximately 17 feet 6 inches from the roof eve to the ground below on the back (west) side of the home.

(a) On or about July 31, 2024, at W257S5357 Wood Lilly Ln, Waukesha, WI 53189, employees were accessing the roof to conduct roofing work from a ladder at the back of the home which did not extend at least three (3) feet above the upper landing surface, exposing employees to a fall hazard of approximately 17 feet 6 inches.
