29 CFR 1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I, was not worn and attached to the boom or basket while working from an aerial lift:  a) On August 01, 2024, at 502 4th Street SE in Hillsboro, North Dakota, an employee cutting a storm-damaged tree while working from an aerial lift basket elevated over 20 feet was not equipped with a personal fall arrest or travel restraint system.

29 CFR 1910.135(a)(1): The employer did not ensure employees wore a protective helmet when working in areas where there is a potential for injury to the head from falling objects.  a) On August 01, 2024, at 502 4th Street SE in Hillsboro, North Dakota, employees performing tree trimming services were not wearing protective helmets. Employees' head was exposed to impacts from falling tools and branches exposing employees to struck-by falling object hazards.

29 CFR 1910.67(c)(2)(ii): Untrained persons were operating an aerial lift.  a) On August 01, 2024, at 502 4th Street SE in Hillsboro, North Dakota, an employee was cutting a storm-damaged tree while elevated by an aerial lift.  Training had not been provided to the employee to recognize hazards associated with working from elevations or operating the aerial lift basket.
