29 CFR  1910.1052(d)(1)(i):  Where Methylene Choride is present in the workplace, the employer shall determine each employee's exposure by either: (A) Taking a personal breathing zone air sample of each employee's exposure; or (B) Taking personal breathing zone air samples that are representative of each employee's exposure.  (A)  The employer did not determine each employee's exposure as required.  On or about August 15, 2024, the employees working in the Analytical Lab were using methylene chloride as an extraction solvent during the sample preparation and analysis of beta-carotene products. The employer failed to determine each employee's exposure by taking a personal breathing zone air samples that are representative of each employee's exposure.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.1052(l)(1): The employer did not provide information and training for each affected employee prior to or at the time of initial assignment to a job involving potential exposure to methylene chloride:  On or about December 18, 2024, the employees working in the Analytical Lab were using methylene chloride as an extraction solvent during the sample preparation and analysis of beta-carotene products.  The employer did not provide information and training for each affected employee prior to or at the time of initial assignment to a job involving potential exposure to methylene chloride.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about December 18, 2024, the employees working in the Analytical Lab were using methylene chloride as an extraction solvent during the sample preparation and analysis of beta-carotene products.  The employer did not provide employees with effective information and training on hazardous chemicals in their work are at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
