OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   a) 215 Grandview Avenue, Edgemoor, De 19809 (Roadway): On or about August 19, 2024, the employer exposed employees to struck by/caught in hazards when one employee was observed using his leg to push branches and tree debris in the active chipper.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in paragraphs (f), (g), & (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes items (i) and (ii) of this subparagraph:  a) 215 Grandview Ave. Edgemoor Delaware 19809: On or about August 19, 2024, The employer did not provide or maintain a hazardous communication program to include labels and other forms of warning, safety data sheets, and employee information and training as required.  ABATEMENT NOTE: A written program shall include description of how the criteria for the following will be met:  1. Labeling and other forms of warning; 2. Material Safety Data Sheets; 3. Employee information and training  Additionally, a list of hazardous chemicals known to be preset in the workplace must be compiled. Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazards, including a description of the labeling system used in the facility and of the availability of material safety data sheets, must also be addressed. The written program must be made available upon request.

29 CFR 1910.151(b):There was neither an infirmary, clinic, or hospital used for the treatment of all injured employees in near proximity to the workplace nor a person or persons adequately trained to render first aid.  a) 215 Grandview Ave. Edgemoor Delaware 19809: On or about August 19, 2024,  the employer failed to provide a first-aid kit with minimal acceptable number and type of first-aid supplies available for employee use. The first-aid kit failed to contain such as but not limited to gauze pads, box adhesive Band-Aids, one package gauze roller bandage at least 2 inches wide, two triangular bandages, wound cleaning agent, scissors, tweezers, adhesive tape, latex gloves, resuscitation equipment such as a resuscitating bag, airway, pocket mask, elastic wraps, split.   b) a) 215 Grandview Ave. Edgemoor Delaware 19809: On or about August 19, 2024, the employer failed to have a person or persons adequately trained to render first-aid. The area is covered by local volunteer fire departments which have a response time of 8-10 minutes and a drivetime to the local hospital of 13 minutes from this address.
