29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Trexx LLC, failed to document abatement within 10 calendar days after the abatement date that the following cited violation had been corrected:  Citation 1, Item 1 a Serious violation of 29 CFR 1926.102(a)(1) with an abatement date of  September 12, 2024.  Citation 1, Item 3 a Serious violation of 29 CFR 1926.503(a)(1) with an abatement date of  October 1, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.102(a)(1):The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  (a) On or about August 22, 2024, at 940 E. Elm St, Oak Creek, WI 53154, the employer did not ensure employees conducting installation of a new residential roof, using hand tools and circular saws were wearing eye protection. This exposed the employees to struck by hazards and eye injuries.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about August 22, 2024, at 940 E. Elm St, Oak Creek, WI 53154, employees installing a roof on a residential home roof with an approximately 6:12 pitch were not using fall protection. This exposed employees to a fall hazard of approximately 13 feet 2 inches from the roof eve to the ground below on the left (West) side of the home.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  (a) On or about August 22, 2024, at 940 E. Elm St, Oak Creek, WI 53154, the employer did not ensure that employees exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work.
